Hearing Set for Former Washington County Judge Charged With Stealing Cocaine

The preliminary hearing has been set for retired Washington County Common Pleas Judge Paul Pozonsky, who has been charged with stealing cocaine evidence in cases he presided over.

Court officials on Monday confirmed that Pozonsky, 57, formerly of North Strabane, is scheduled to appear for the hearing scheduled for 10 a.m. Aug. 21.

Armstrong County Senior District Judge Michael Gerheim will oversee the hearing, court officials added.

Pozonsky in May was charged with:

  • one count of theft;
  • one count of restricted activities;
  • four counts of possession;
  • four counts of theft by failure to make required disposition;
  • one count of misapplication of entrusted property; and
  • one count of obstructing the administration of law
In May 2011, Judge Pozonsky began to request that police bring to his courtroom the controlled substances—usually cocaine—that had been confiscated in drug cases, according to investigators.

The controlled substances would be entered into evidence and retained by Pozonsky or his staff, according to information released by the state Attorney General.

In May 2012, state police investigators, pursuant to an Order issued by the President Judge of the Washington County Court of Common Pleas, examined the evidence envelopes and found cocaine was either missing or had been tampered with.

The charges stem from a grand jury investigation. To read the grand jury presentment, click here.
